Noida: The additional chief judicial magistrate court on Wednesday ordered police to register an FIR against several persons of Yatharth Hospital for being involved in a case of medical negligence during a woman’s gallbladder stone removal surgery.Judge Mayank Tripathi-II directed officers from Beta 2 police station to inform the court about the action they take in the case within a week.Zeta 1 resident Dhirendra Singh had approached the court alleging that his wife, Rakhi, became critically ill after a routine gallbladder stone removal operation because of negligence by a Dr Hamidi, a general surgeon at Yatharth Hospital. He said he took her for a consultation at the hospital on May 30, 2025, after his wife complained of abdominal pain. She underwent an ultrasound that revealed there were two stones in her gallbladder.Dr Hamidi performed a laparoscopic cholecystectomy on her the next day and told Singh the surgery was successful. After the surgery, he showed Singh one of the stones he had removed. When asked about the second stone, the hospital staff allegedly told Singh it had been sent to the laboratory for testing.When Rakhi regained consciousness, she complained of pain in her stomach and shoulder, but the doctor said such pain was associated with the surgery and was normal. She was discharged on June 2.On the same night, she complained of severe pain at home and Singh called Yatharth Hospital to report her condition. The next day, another USG test was conducted and the doctors described her condition as normal and asked her to go home. However, a consultation with another doctor revealed that only one of the stones had been removed and the other was still inside her body.Following this, Singh contacted Dr Hamidi and the owner of Yatharth Hospital, Kapil Tyagi, to inquire about the situation. Both admitted that there had been some error and assured him that they would ‘fix it’. Singh claimed that Tyagi and Dr Hamidi were fully aware that they had only removed one of the two stones from the gallbladder and despite being aware of her critical condition, neglected to treat her properly.The second doctor informed Singh that his wife was in critical condition and needed to be admitted to the ICU immediately. Subsequently, Rakhi had to undergo another procedure, in which fluid had to be drained from her stomach.Singh then filed a complaint application to the SHO of Beta 2 police station on July 3, 2025, for taking legal action against the doctors and hospital management, followed by an application to the DCP and the district magistrate.On the direction of the DM, a committee was constituted by the chief medical officer. However, the committee presented an investigation report which was erroneous from the legal point of view, with a mismatch in the names of doctors in the committee and those who put their signatures in the final report.The applicant then submitted a complaint application to the DM and the principal secretary of the ministry of health in Uttar Pradesh on Sept 23, but no action was taken by any official to date.Perusing the documents on record, the court said, “A review of the documents attached to the application, the medical documents, and the statements made by the applicant prima facie indicates the need for an inquiry, the truth of which can only be ascertained through investigation. It is inappropriate to conduct a thorough investigation.”
