LOC over marriage dispute: HC seeks Haryana response to US green card holder’s plea

Chandigarh: The Punjab and Haryana high court on Saturday sought Haryana govt’s response to a US green card holder’s plea challenging a look out circular (LOC) issued against him in a domestic violence case. The next hearing is on Oct 14.Justice Tribhuvan Dahiya adjourned the case after the Union govt said the LOC was issued on the instructions of the Faridabad commissioner of police. Haryana Police sought time to explain the reasons for issuing it.The petitioner, represented by senior advocate Anil Malhotra, argued the LOC was unjustified as he was not accused of any heinous offence. An FIR was registered against him and his family members at Faridabad’s Sector 8 police station on April 21, 2025, under Sections 120-B, 406, 498-A and 506 of the IPC.According to the petitioner, he married in the US in Oct 2023 and has two children. The superior court of New Jersey granted a divorce decree on Aug 19, 2025. He alleged his former wife brought their children to India without his consent while mediation proceedings were pending in the US. His counsel also cited a Jan 30, 2025, US court order that allegedly held her guilty of contempt.The petitioner said he had joined the investigation online and responded to the investigating officer on several occasions. After landing in Chandigarh on Oct 4, he learnt of the LOC, furnished an undertaking and was allowed to leave the airport. He appeared before Faridabad police the next day.He has also filed separate petitions seeking quashing of the FIR and custody of his children.
