Repair in 30 days, panel tells builder after seepage in Greater Noida flat

Noida: The district consumer commission has held Supertech Limited guilty of deficiency in service after a flat sold by the builder in Ecovillage-2 developed seepage and sewage problems, ordering the company to rectify the defects within 30 days and pay the owner Rs 4,000 towards mental anguish and litigation costs.The complaint was filed in May 2019 by Minimol Chanchal Singh, a resident of Sector 16B, who had booked a flat in Tower C-3 of the condominium built by Supertech Limited. The flat was allotted to Singh in Sept 2016 for Rs 27 lakh, inclusive of registry charges.Singh told the commission that from Sept 30, 2016, the flat began accumulating dirty sewer water and dampness. Despite repeated requests to the builder, no remedial action was taken. She alleged that the maintenance agency, which charged Rs 3,223 per month, had failed to address the problem. She submitted that it had promised a pipeline disconnection, but never carried it out and also failed to install a sewage treatment plant. She contended the flats were sold before construction was complete.Supertech denied the allegations, arguing that the flat had been allotted to Singh’s husband, Chanchal Singh Mahapatra, who had taken possession to his full satisfaction, following which a lease deed was executed. The builder’s counsel contended that maintenance was governed by a separate agreement between Supertech Estate Private Limited and a maintenance agency, and that the complainant’s grievance lay with that agency, not the developer.The commission rejected the argument. It noted that Supertech itself had arranged the maintenance agreement and that Supertech Estates Pvt Ltd functioned as the maintenance agency. The deficiencies, it observed, had only become apparent after the complainant had been living in the flat for three years, a circumstance that did not absolve the builder of responsibility. The commission directed Supertech Limited, through its chairman and managing director, to resolve the grievances within 30 days.
