Nadaprabhu Kempegowda Layout project in Bengaluru: Rera disposes of plaints over missing paperwork

Bengaluru: The Nadaprabhu Kempegowda Layout (NKPL) project once again came under the Karnataka Rera radar as multiple allottees have approached the authority against BDA, seeking relief for delays in the handover of units. However, the authority disposed of the complaints for lacking proper documents.The saga began when multiple allottees filed complaints seeking a refund of their money with an interest. After examining the pleadings and documents, the authority observed the complainants failed to submit essential documents such as the sale agreement, construction agreement, payment receipts, statement of accounts and other supporting materials.It noted that adjudication requires examination of contractual terms, payment details, timeline commitments and corresponding breaches. In the absence of these, the authority is unable to determine the exact nature of obligations, extent of payments made, delay or entitlement to relief.Despite opportunities granted, allottees failed to furnish the details. In the absence of documentary evidence, the authority said, it is not in a position to compute the delay period and statutory interest on an individual basis. The bench said: “Mere production of a sale deed, without the foundational contractual and financial documents, is insufficient to conclusively adjudicate the claims raised.”The authority stated that in case of any dispute over the principal amount or interest calculation, parties must first undertake reconciliation based on documentary proof. If issues persist thereafter, the complainant is free to initiate appropriate proceedings in accordance with the law.The authority bench headed by president Rakesh Singh and member Gurijala Ravindranadha Reddy on April 8 disposed of the case and said new complaints can be filed by the allottees by producing the required documents.
