Noida: A fast-track court granted bail to a man accused of cheating his second wife by hiding his marital status. He had allegedly converted to Hinduism to marry her, but hid the fact that he was already married before and had a child from the marriage.The court also noted that both the man and the woman had been married earlier and had accused each other of concealing that fact.On Monday, Additional sessions judge Satyendra Singh granted conditional bail to Yasin alias Aditya, requiring him to furnish a surety and a personal bond of Rs 50,000 each, while also ordering that he must cooperate with the investigation.The judge observed that Yasin converted to Hinduism and did not force the woman to convert. “The fact that the woman married the accused is clear from the FIR; however, the fact that both the victim and the accused were previously married is also reflected. The accused has been detained in the district jail since May 5, 2026. Considering the above facts and circumstances, without expressing any opinion on the merits, the grounds for bail are sufficient,” the judge ruled.This case is connected to an FIR filed at Sector 39 police station by Kiran Kumari, a resident of Bareilly, under sections 323 (voluntarily causing hurt), 504 (intentional insult to breach peace), and 508 (forcing someone to do an act by making them believe that a god or divine power will curse them if they do not obey) of the IPC, along with Sections 493 (deceitful marriage belief) and 495 (bigamy with hidden truth) of the IPC, informing police that she met Yasin in 2021 when she started working at Mart Tally Services Company in Noida. There, Yasin allegedly proposed to marry her and even agreed to convert to Hinduism, and both got married on March 4, 2024.“I later learned that Yasin married a woman named Nisha in 2023, with whom he has a son. He concealed this fact from me and deceived me into developing physical relations before marriage,” she alleged, and accordingly, an FIR was registered on May 5, following which he was arrested the same day.Counsel for the applicant refuted the allegations and said that the victim was well aware of the accused’s previous marriage. He pointed out that Kiran, in her FIR, has admitted that Aditya’s previous wife had requested her not to marry him, but she ignored that and insisted on marrying him.“There is no doubt that the complainant was well aware of the applicant’s previous marriage. She admits that the applicant was Muslim by religion and had converted to Hinduism before marrying her. According to Muslim law, the day the applicant renounces Islam, he ceases to be the husband of his former wife. Furthermore, according to Muslim law, apostasy by either party to a marriage is considered an automatic dissolution of the marriage and the marriage is immediately dissolved,” he argued.The applicant’s counsel further said that, in contrast, Kiran never informed the applicant of her previous marriage and never obtained a divorce.Having heard both sides, the court observed that the complainant concealed her previous marriage too, and the FIR clearly shows that she was well aware of the accused’s marriage and had communicated with his previous wife; therefore, it is inconceivable that the applicant deceived the complainant.
