‘Love, not lust’: Bombay high court nixes FIR after man, former GF say they are happily married

MUMBAI: Bombay high court recently quashed an FIR against a man who was booked on his ex-girlfriend’s complaint that he had sexual intercourse with her by making a false promise to marry.Both told HC they had reconciled their differences and are happily married. “This is a case of love between the applicant and the respondent, not lust. Continuation of the criminal proceedings will result in agony and inconvenience to the applicant and the respondent,’’ said justice Ashwin Bhobe on April 20.The man filed an application to quash the Sept 2025 FIR registered at Taloja police station. He met the woman while working at an electronic store. Their friendship developed into a relationship and subsequently into aconsensual physical relationship.Due to “a misunderstanding,” she filed a complaint that resulted in the FIR. Both reconciled their differences and married on March 25. The man’s advocate Ganesh Gupta submitted the marriage certificate. On March 30, the woman gave her no objection for quashing the FIR. Justice Bhobe noted that the woman filed the affidavit out of her own free will and without any pressure or coercion from any person.“ She further states that she loves her husband. She states that she is not interested in continuing the criminal proceedings and seeks to have them ended. She states that the continuation of the criminal proceedings will disturb her married life with the applicant,’’ he added. Justice Bhobe concluded this is a “fit case’’ to exercise HC’s jurisdiction “to secure the ends of justice.” Having regard to Supreme Court pronouncements, he quashed the FIR and the chargesheet, if filed.
