Panaji: A North Goa court has directed that charges be framed against a man accused of raping a woman with an intellectual disability.The court ordered charges under Section 64(2)(k) of the BNSS for rape of a woman with a mental illness or physical disability, and under Section 92 of the Rights of Persons with Disabilities Act, 2016, for allegedly exploiting a woman with a disability by taking advantage of a position of influence.According to the prosecution, the accused took the woman to an open area about 100m from her house and raped her in Sep 2025. While the court had earlier found sufficient material to frame a rape charge under the BNSS, the prosecution later sought addition of a charge under the Disabilities Act.It submitted the survivor’s statement, recorded with the help of a special educator, and a certificate confirming her intellectual disability. Sessions judge Vijaya Ambre said the material on record shows a prima facie case for framing the additional charge under the Disabilities Act.
