Raj HC clears way for JDA to proceed with New Sanganer Road widening in Jaipur

Jaipur: The Rajasthan High Court Friday refused to modify its earlier order directing the widening of New Sanganer Road from Setu Restaurant to Vande Mataram Circle, dismissing appeals against the interim directions and clearing the way for the Jaipur Development Authority (JDA) to proceed with the project.A division bench of Justice Inderjeet Singh and Justice Sandeep Taneja held that no case was made out to interfere with the interim order passed by the single bench. The order permits construction of the proposed 100-foot-wide road with an 80-foot carriageway after removing encroachments while maintaining a 20-foot setback.The appeals challenged the interim directions related to the 1,850-metre road corridor, alleging that the road alignment had been changed arbitrarily and that the order suffered legal infirmities. The appellants also argued that several affected landowners were not given an opportunity to be heard before the interim order was passed.Rejecting the submissions, the division bench observed that the single bench had only directed construction of the road after leaving the required setback and removing encroachments. Since the main writ petitions remain pending before the single bench, the court held there was no justification for modifying the interim order at this stage.The bench further said the appellants failed to establish any grounds for appellate interference and clarified that all issues raised by the parties could be examined during the final hearing of the pending petitions.Counsel for the respondents submitted that there was no dispute over the land required for the project and pointed out that no court had stayed its implementation.With the appeals dismissed, the JDA is expected to continue the road-widening project, which is aimed at easing traffic congestion on the busy corridor.
