AHMEDABAD: A woman assistant sub-inspector (ASI) has approached Gujarat High Court challenging her transfer from Ahmedabad Rural to Surat district, contending that the decision was a second punishment over her love affair with a department colleague, for which she had already faced departmental action.High Court issued notice to director general of police (DGP) and sought a response on the plea. The matter has been posted for further hearing on Nov 23.According to the petition, the 35-year-old ASI and a male colleague, who was posted as a driver, faced departmental proceedings after allegations regarding their personal relationship surfaced during a matrimonial dispute involving the latter. The colleague’s wife had lodged an FIR at Mahila Police Station, Ahmedabad (Rural), alleging domestic violence and dowry harassment. She alleged that her husband’s illicit relationship was reason for the marital discord.Following an internal inquiry, police authorities found both personnel guilty of misconduct. Superintendent of police imposed a penalty of stoppage of increments for two years, which was later reduced to one year upon representation. Both officers accepted the punishment and did not challenge it.The petition states that following repeated complaints made by the driver’s wife, SP reported the matter to state home department and DGP. In May 2025, DGP issued an order transferring both of them out of Ahmedabad district. While the male officer was shifted to Kutch, the woman officer was transferred to Surat.Challenging the transfer, the petitioner argued before HC that the order was not a routine administrative exercise but was founded on the very allegations that had already resulted in disciplinary punishment. The petition reads, “Despite she having been subjected to departmental action, authorities transferred her on the basis of the same FIR. Hence the transfer order is punitive in nature and passed as an additional punishment arising out of the same allegations amounting to double jeopardy and colourable exercise of administrative power.”The state govt opposed the petition, contending that police service was inherently transferable. The petitioner’s counsel, however, submitted that she had repeatedly sought a personal hearing before the authorities to present her case.After issuing notice, HC scheduled the next hearing for Nov 23.
