Ghaziabad: A sessions court refused to give relief to a murder convict after he was accused in a fresh attempt to murder case while he was out on bail.While refusing to grant bail, sessions judge Vinod Singh Rawat said without going into the merits of the case, there was no sufficient basis to release the applicant.The matter is linked to a complaint filed by Akshay Sindhu, a dairy farmer, on Aug 21. He said that the accused, Dev Kumar, came to his house with a pistol in his hand and started abusing him. He then started threatening him and suddenly opened fire in his direction, the complainant said. The complainant’s family then overpowered him and handed him over to police.The defendant’s counsel said Kumar had been falsely implicated in the case. “The complainant himself invited him to his home and, out of conspiracy and enmity, severely assaulted him, resulting in severe injuries,” he said, producing a medical report on the injury.District govt counsel (criminal) Rajesh Chandra Sharma strongly opposed the bail application, arguing that the accused, under the influence of alcohol, abused and fired a pistol with the intent to kill Sindhu. Kumar was apprehended at the scene with the pistol and cartridges, he added.Sharma also pointed out that the accused was previously convicted for killing his wife and, if bail was granted, there is a strong possibility that he may tamper with the evidence.Having heard both sides, the court denied Kumar bail.
