HC orders probe into alleged fake order in MLA son’s voters’ list case

Jaipur: Rajasthan High Court has ordered an inquiry into allegations that a forged court order was used to restore the name of Jai Prakash, son of Surajgarh Congress MLA Shravan Kumar, in the voters’ list of Jeeni gram panchayat in Jhunjhunu district for the ongoing Panchayati Raj elections.A single-judge bench of Justice Anand Sharma, hearing Jai Prakash’s petition against the state and others Wednesday, directed the high court registrar (judicial) to investigate the matter and submit a report within three days. The case has been listed for further hearing on Nov 2.During the hearing, Amit Kuri, counsel for the state election commission, produced a letter dated Oct 6 issued by the electoral officer of Surajgarh panchayat samiti. “The letter stated that Jai Prakash had provided what he claimed to be a high court order from the same date, asserting that the court had directed the restoration of his name on the electoral roll for Ward No 5 of the Jeeni gram panchayat,” Kuri told the single bench.Kuri said the purported order also claimed Jai Prakash would be entitled to file his nomination and contest the elections, and that his nomination should be accepted if it otherwise met requirements.Kuri informed the bench that an inquiry found no such interim order had been passed. “During then, his case had only been scheduled for Oct 27. The petitioner fabricated the order to gain an undue advantage, mislead election officials and participate in the electoral process,” Kuri submitted. The single bench compared the photocopy of the alleged high court order with the original judicial record and found that no interim relief had been granted on Oct 16.Calling it “a serious attempt to interfere with the administration of justice”, the high court said the matter involved “allegations of forgery and fabrication”.
