Exercise caution before you click on any link or open attachments.TNNLudhiana: District Consumer Disputes Redressal Commission has penalised an old car seller company (Car Bazar) for deficiency in service after it failed to refund advance amount of Rs.50,000 for a “defective” car being sold by it. The commission ordered the car bazar near the Phullanwal Chowk to refund the amount of Rs.50,000 to the complainant Kamaljit of Basti Jodhewal in Ludhiana and also ordered it to pay a composite cost of Rs.5,000 to him.As per the complaint, the complainant contacted the opposite parties for purchase of used/second hand car and they showed many cars to him. The complainant selected a Maruti Baleno car for a total sale price of Rs.5,56,500. The opposite parties promised and assured that the said vehicle is having no patent and latent defect, to which, the complainant believed and agreed to purchase the aforesaid car and made advance payment of Rs.50,000 against receipt dated 2 June 2025 issued by the opposite parties.Out of the said amount of Rs.50,000 the complainant paid Rs.5000 and Rs.10,000 through Google pay on 18 May 2025 and 28 May 2025 and remaining amount was paid in cash on 30 May 2025. The opposite parties promised to deliver the vehicle as and when required by the complainant. The complainant is not well versed with mechanical or body line of the cars as such, complainant took his known mechanic namely Harnoor Singh on 3 June 2025 who checked the car and found that the same was defective and was having some mechanical and bodyline deformities. The complainant refused to purchase the abovesaid car and other cars shown by the opposite parties are also defective one. The complainant requested the opposite parties to make refund of advance amount but they failed to refund the amount despite repeated approaches and threatened the complainant. The complainant claimed to have suffered mental tension and harassment etc. due to such act and conduct of opposite parties. Hence this complaint, whereby the complainant has prayed for issuance of direction to the opposite parties to pay Rs.50,000 along with interest as well as Rs.1 Lakh as compensation and Rs.33,000 as litigation expenses to the complainant.Upon notice, nobody turned up on behalf of opposite parties despite service and were proceeded against exparte.The commission after appreciating the evidence on record observed that the opposite parties unjustly retained the amount without any rhyme or reason which amounts to unfair trade practice and rendering of deficiency in service.“As a result, the opposite parties are liable to refund the entire advance amount of Rs.50,000 to the complainant along with composite compensation of Rs.5000” the commission held.—shariq.majeed@timesgroup.com
