Agartala: In response to the recent surge in post-poll violence following the Tripura Tribal Areas Autonomous District Council (ADC) elections, the state govt has decided to implement the Tripura Recovery of Damages to Public and Private Property Act, 2021.This move aims to hold perpetrators accountable and ensure compensation for the damages caused, director general of police (DGP) Anurag said.
The unrest erupted after the declaration of results for the ADC elections on April 17, leaving more than 500 people homeless and causing damage to public and private properties.While the Act was passed by the state assembly in April 2021 to address such situations, including those arising from clashes, strikes, riots, bandhs, and public protests, it had yet to be thoroughly enforced until now. The legislation facilitates the recovery of damages through the formation of claims tribunals, which assess losses and determine the appropriate compensation.A claims commissioner, appointed by the state govt, oversees this process. Under the Act, “damages” encompass any loss, injury, or deterioration caused by individuals or groups, while “mischief” aligns with its definition under Section 425 of the Indian Penal Code.In cases of violence, police must submit a detailed report to the claims tribunal within three months. The tribunal then evaluates the degree of damage and assesses compensation to be reclaimed from those responsible.

To address immediate relief needs, CM Manik Saha visited the affected areas and allocated Rs 64.5 lakh from the chief minister’s relief fund to assist victims and their families. However, this support is only a partial measure given the extent of the destruction. Speaking after a review meeting on the situation, Saha emphasised the importance of enforcing the Act to not only recover damages from offenders but also deter future incidents.
