Tinsukia commercial building owners get 10 days to fix setback violations

Dibrugarh: Tinsukia Municipal Board has given commercial building owners 10 days to clear setback violations.The public notice, issued by TMB commissioner Nayan Jyoti Nath on Tuesday, warned of strict action against owners and occupiers of commercial buildings within the municipal area if they fail to comply.The notice said every commercial building must maintain minimum setbacks from existing roads as per the building bylaws under which its construction was originally sanctioned.Buildings approved under the 2000-2014 bylaws must maintain a setback based on height. A 3-metre front setback is a must for structures up to 11.5 metres tall, while wider rear and side setbacks are necessary for taller buildings.Those sanctioned under the 2022 bylaws must follow graded front open-space norms based on street width and building height. Smaller plots will be governed by separate norms based on plot size.The notice said any encroachment or violation of setback norms must be rectified within 10 days of receipt. Failure to comply will invite action under Sections 158(a) and 159 of the Assam Municipal Act, 1956, including removal of unauthorised obstructions or encroachments.“We want to give building owners a fair chance to correct these violations themselves. But if they fail to comply within the stipulated period, the Board will remove encroachments without any further notice,” Nath said.
