Restaurants, shops, courier outlets encroach govt land in Gurgaon, plea seeks demolition

Gurgaon: A fresh representation submitted to MCG, GMDA and HSVP has sought immediate enforcement action against an alleged illegal commercial cluster operating on govt land in Sector 42, with the complainant citing recent Supreme Court directions on unauthorised constructions and land-use violations.The petitioner, Devendra Kumar Agrawal, along with other residents, has alleged that a large number of commercial establishments, including restaurants, eateries, courier outlets, scrap dealers, pharmacies and construction material depots, are operating on govt land in Chakkarpur village near Golf Course Road without statutory approvals, sanctioned building plans or requisite environmental clearances. The representation seeks demarcation of the land, removal of encroachments and demolition of the alleged unauthorised structures.According to the representation, a GMDA survey conducted on June 9, 2025 identified unauthorised shops on govt land falling under khasra numbers 535, 536, 537, 538 and 540 near Krishna Hotel, opposite Global Foyer Mall. The complainant also referred to a GMDA restoration order dated Jan 13, 2026, directing owners and occupiers of the alleged unauthorised constructions to restore the land, claiming that the directions remain unimplemented.Agrawal also approached National Green Tribunal over the issue, alleging environmental and land-use violations. The matter is currently pending before the tribunal. He has alleged that despite the ongoing proceedings, the commercial establishments continue to operate.The latest representation also relies on recent Supreme Court directions in Loganathan vs State of Tamil Nadu, in which the apex court expressed concern over widespread violations of building bye-laws and misuse of land earmarked for other purposes.The court directed municipal authorities across the country to identify such violations and undertake enforcement measures, including sealing and demolition wherever warranted under law. The representation states that GMDA was also impleaded in the proceedings and directed to submit affidavits detailing action taken against unauthorised constructions within its jurisdiction.The petitioner has further cited the Supreme Court’s judgement in Rajendra Kumar Barjatya vs U.P. Avas Evam Vikas Parishad, which held that unauthorised constructions cannot be legitimised merely because of the passage of time and reiterated that planning norm violations must be dealt with strictly.A senior GMDA official confirmed that the representation has been received and will be discussed with higher authorities.Seeking time-bound action, the residents have urged MCG, GMDA and HSVP to demarcate the land, remove encroachments and demolish unauthorised structures in compliance with the Supreme Court’s directions.
