New Delhi: Days after it cancelled the bail plea of a school staffer accused of raping a minor, Delhi High Court Wednesday cancelled the bail granted to a woman teacher in the same case.Noting that Pocso cases warrant “utmost caution”, the court asked her to surrender in three days, in connection with the alleged rape of a three-year-old girl by a staff member inside a private school in west Delhi’s Janakpuri. Last month, HC had set aside the bail granted to the main accused, the school caretaker.Justice Saurabh Banerjee Wednesday observed that while considering bail in such cases, “essential surrounding factors” like physical, emotional, mental and psychological harm to the survivor had to be given due weightage.It was dealing with a plea by Delhi Police challenging the trial court order that granted bail to the teacher on May 20. The teacher was arrested for allegedly concealing the incident.The trial court wrongly granted relief to the teacher merely because the survivor did not disclose her name in the complaint, HC said. Emphasising that any three-year-old cannot be expected to reveal every detail while making the initial complaint, Justice Banerjee said the trial court erred in ignoring the fact that the survivor had not only identified the teacher in the presence of her mother but also the incident spot.
