Court orders safeguards for accused in CM assault case

New Delhi: A Delhi court has directed the jail superintendent to ensure the safety and security of Sakriya Rajeshbhai, accused for alleged assault on Chief minister Rekha Gupta during a Jan Sunwai in 2025, after taking note of allegations that he was assaulted in jail and continued to face threats from officials and inmates.The directions came from additional sessions judge Nishant Garg while deciding two applications filed by accused Khimjibhai and Tehsin Raza, one on May 7 seeking a separate barrack and protection inside jail, and another on May 22 seeking protection and a medical examination.On the first application, the prosecution submitted that the accused had been lodged in a “special security ward” and, at his own request, was later allowed certain relaxation to move with other inmates. However, the defence claimed voice recordings existed of threats being made to the accused.The judge also pointed to the absence of any information regarding the alleged threats that extended to the duo. “The report of jail superintendent is silent on this aspect,” the court referred to the alleged threats being extended inside jail and that the accused was physically assaulted by SI Anil Yadav and ASI Mohan Sharma on May 4, 2026.On the second application, the prosecution placed a medical report stating that Sakriya Rajeshbhai was examined on June 4, after the alleged assault on May 4. The report said his vitals were normal and there were no fresh injury marks. The defence, however, contended that despite the absence of visible injuries, threats from jail officials and fellow inmates had continued even after the alleged assault.Taking note of the rival submissions, the court directed, the jail superintendent “to ensure the safety and security of both the accused persons in the jail premises; he shall take all possible steps as per rules to ensure that no threats are being extended to the accused persons either by the jail officials or by other inmates.”In December last year, the court formally framed an attempt to murder charge against the duo, holding that a prima facie case existed against them.
