Ahmedabad: Nearly five years after a woman approached the CID (crime) alleging that a forged will had robbed her of her ancestral inheritance, her son on Saturday filed an FIR alleging forgery, claiming that his now-deceased mother was denied inheritance rights.The complaint, filed by 56-year-old Ratilal Thakor, alleges that his late mother, Shakari, was the only biological child of Khodaji Thakor from his first marriage and, therefore, his sole legal heir. She was allegedly kept out of her father’s estate through a fabricated will executed in 2006.“My mother repeatedly told me that she was the only child, but she never received a share in her father’s property. She kept fighting for her rights until her death,” Ratilal stated in the FIR.According to the complaint, Khodaji divorced Shakari’s mother, Dhabu, shortly after Shakari’s birth. Dhabu and Khodaji both remarried. However, Khodaji’s second marriage remained childless, making Shakari his only biological child, the FIR states.Ratilal alleged that six persons — Shakari’s relatives — entered into a criminal conspiracy to ensure that she did not inherit her father’s estate. “Instead of allowing the property to pass to the only legal heir, they allegedly created a false will and distributed the assets among relatives and even persons who had no direct blood relation with my grandfather,” he said.The FIR alleges that the accused prepared a forged will by fabricating Khodaji’s signatures and falsely showing that it was executed while he was admitted as an indoor patient at Sagar Hospital on May 16, 2006. “My mother had personally seen the will and told me the signatures were not those of her father. She also said he was never admitted to the hospital on the date mentioned in the document,” Ratilal said.The complainant said his mother first learnt about the alleged fraud around 2012 and immediately sought to join pending civil litigation as Khodaji’s legal heir. He alleged that she was initially misled into withdrawing her application but later filed another plea, following which the civil court recognised her as a direct legal heir in the proceedings.In July 2021, Shakari approached CID (crime), which initiated a preliminary inquiry and reportedly sent the disputed signatures for forensic examination. She died on July 26, 2022, before criminal proceedings could begin.Ratilal’s FIR notes the date of crime between May 16, 2006, when Khodaji died, and July 26, 2022, when Shakari died.The FIR names six accused, including two who have since died. CID (crime) has booked them for offences including cheating, criminal breach of trust, forgery of valuable security, using forged documents as genuine and criminal conspiracy.
