Gurgaon: Police have filed a chargesheet against two men accused of deliberately ramming their car into a biker on Golf Course Road on Sept 13. A local court took cognisance of the chargesheet on Monday, paving the way for a trial on the charge of attempt to murder. The accused, Kalyan Bainsla and Lavnish, who was in the passenger seat, were arrested in Rajasthan on Sept 15 and later sent to judicial custody. The incident involved biker Shivani Chauhan, also known as Sia, and went viral on social media.Sector 56 police station SHO Inspector Sukhpal confirmed that the chargesheet had been filed in court and that it included the attempt-to-murder charge. “The police investigation concluded that the driver deliberately rammed the vehicle into Chauhan’s motorcycle, leaving her injured,” another police officer said. The incident took place when Chauhan was riding her Aprilia RS 457 with a group of bikers on Golf Course Road. An altercation broke out between the bikers and two men in a car. Police said the accused followed her for around 2 km and asked her to stop. When she did not, and instead signalled the driver to move away, the car rammed her bike.It initially appeared to be a road accident. An FIR was registered on Sept 14, after the video of the collision went viral, against the then-unidentified driver under sections 281 and 125 of Bharatiya Nyaya Sanhita (BNS). The police commissioner then constituted a five-member Special Investigation Team (SIT), headed by the ACP (crime and women). An examination of CCTV footage and the motorcycle’s dashcam recording led investigators to conclude that the collision was intentional, and police invoked Section 109(1) BNS, which deals with attempt to murder. The white Maruti Ciaz allegedly used in the incident was seized after the arrests.Police also recorded a detailed statement from Chauhan in Delhi. She accused the occupants of the car of making obscene remarks and behaving inappropriately towards her before the collision. Based on her statement and other evidence, police added provisions relating to stalking and insulting the modesty of a woman.Investigators have relied on more than 15 CCTV recordings from different locations. These include footage from cameras installed by GMDA and DLF, the helmet-mounted camera on Chauhan’s motorcycle, and footage recorded by an employee of a club.In its report submitted last week, the SIT concluded that the accused had intentionally hit the woman biker and recommended that the attempt-to-murder charge be retained. With the court having taken cognisance, the case will now proceed to trial.
