No urgent hearing on IYC plea on protest

New Delhi: Delhi High Court Friday refused to grant an urgent hearing on a plea by Indian Youth Congress (IYC) seeking permission to protest against chief election commissioner Gyanesh Kumar at Jantar Mantar over the alleged irregularities in the SIR exercise.The court said the petition will be listed for Oct 12 after the counsel for the petitioner mentioned the matter and tried to assure the court that all defects have been removed but the plea was not yet listed. The plea was first mentioned Thursday. Since it did not come up for hearing, the counsel again mentioned it.A bench of acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma declined the request. “What is the urgency today? We will hear it Monday. It will be listed for Monday,” the bench said.On the aspect of urgency, the counsel said: “Because every day my lordships are seeing, the designated site (for protest) is not allowed.”Through its national president Uday Bhanu Chib, the organisation approached the court challenging Delhi Police’s Oct 1 communication denying the outfit permission to hold a peaceful demonstration at Jantar Mantar.IYC requested Delhi Police on Sept 25 for a protest from Oct 1-25.“The petitioner does not dispute that the State is entitled to regulate assemblies…. The challenge, however, is to the manner and extent of such regulation,” it said.
