2 men accused of firing on cops get bail, Noida court says no policemen injured

Noida: A city court granted bail to two men, accused of firing on a police party with the intent to kill. Additional sessions judge Satyendra Singh noted on Oct 13 that no policemen were injured. “They are accused of firing at the police party during the arrest. However, no one was injured, except for both the accused who were shot in the leg,” the fast-track court said, adding that a 315-bore pistol with a spent cartridge and a live cartridge stuck in the barrel was recovered from Aman and Sandeep. The duo was made accused under sections 109(1) (attempted murder) and 3(5) (common intention) of BNS and 3/25/27 of the Arms Act (unauthorised possession and illegal use of a weapon) in a case registered at Sector 63 police station. The FIR was filed on the basis of a complaint filed on May 18 by sub-inspector Mahesh Chaudhary. The court directed them to furnish a surety of Rs 50,000 and a personal bond of the like amount each with an undertaking to abide by the conditions imposed by the court. Both were directed to cooperate in the investigation, abstain from exerting any pressure on the plaintiff or influencing witnesses in any way and ensure that the witnesses are cross-examined on the said date only if they are present. The accused claimed that they were falsely implicated due to a personal grudge. They argued that there were no independent and impartial witnesses against them to corroborate the police narrative and they both have been languishing in the jail since May 19. The prosecution objected to the bail and said that both are accused of daring to fire on the police and charged with attempted murder.SI Chaudhary said in his complaint that while he was conducting vehicle checking near FNG roundabout, he was tipped off about four criminals accused in the Chotpur Colony murder case, who would be going towards the highway on two motorcycles. When police signalled the criminals to stop for checking, the motorcycle riders took a U-turn in a bid to flee. “Due to the dirt road, the motorcycles skidded out of control and they opened fire on us with the intent to kill. Police asked the criminals to surrender, but they refused and again opened fire on the police. I fired one shot, targeting the criminals below the waist. Sub-inspector Abhinendra Singh then fired another shot. Two criminals fell to the ground,” the plaintiff said. Four accused — Sandeep Kumar, Aman, Piyush and Mohd Yasir — were arrested and overall, three illegal 315-bore pistols, two empty cartridges of 315 bore stuck in the barrel of the pistols, four live cartridges of 315 bore and a knife were recovered.
