Rajkot: A 47-year-old man will serve three years of rigorous imprisonment for stabbing the driver of a drinking-water delivery vehicle in a fight over parking in 2018.In its order dated June 19, a sessions court in Rajkot held a 47-year-old man, Vijay Parmar, guilty of causing hurt by deadly weapon. The court also fined Parmar Rs 25,000 which is to be paid to the victim as compensation.On the morning of Nov 2, 2018, Gaurav Dalsaniya, 20, was delivering mineral water in his commercial vehicle in Vrindavan Society in the city.According to the FIR, Parmar came to the vehicle and demanded that Dalsaniya move it. Even as the young driver agreed to move it, Parmar verbally abused him.After an exchange of words Parmar pulled Dalsaniya out of the vehicle by his collar and stabbed him with knife six times — causing wounds in his right side, on his left shoulder, near his left ear, left elbow and left knee.Parmar was initially charged with attempted murder under Section 307 of the IPC. Additional sessions judge Priyanka Agarwal observed that the attack was the result of a sudden provocation over parking, with no prior enmity or premeditation. As the medical evidence classified the wounds as ‘simple injuries’ and the prosecution failed to prove an intent to kill, the court downgraded the conviction to ‘causing hurt by dangerous weapons’.During arguments on sentencing, the prosecution submitted Parmar’s criminal history. Additional public prosecutor P N Shah said, “Taking his habitual criminal behaviour into account, the court denied Parmar leniency or probation.”
