Ghaziabad: In a relief to 1,600 homebuyers of Sushant Aquapolis, which is under insolvency proceedings, Supreme Court has cleared the path for implementation of the resolution plan by permitting corporate debtor Ansal Urban Condominium to develop a 24-metre-wide pathway at the project without claiming any title over the land.The 26-acre township near Crossings Republik was launched in 2007-2008. Between 2014 and 2017, developer Ansal API submitted layout drafts and revised proposals to Ghaziabad Development Authority (GDA) under the Uttar Pradesh Integrated Township Policy, but financial constraints, mismanagement and disputes with creditors led to lapses in building layout approvals over the years. In 2019, the company was declared insolvent and the project went to the National Company Law Appellate Tribunal (NCLAT), which tasked One City Infrastructure Pvt Ltd with completing it.The resolution plan submitted by One City was approved under Section 31 of the Insolvency and Bankruptcy Code, but construction could not resume as GDA withheld renewal of the development licence and sanction of the revised building plan. The development authority held that the original allottee, Ansal API, could only apply under the rules. One City then moved Supreme Court, which ordered GDA and the UP govt to approve the layout plan.On July 30, SC directed the UP govt and GDA to resolve the issues within two weeks and ordered a site inspection. GDA subsequently told the court it would sanction the building plan after an online application, keeping homebuyers’ interests in mind. On Aug 21, GDA board approved the proposal to pass the revised building plan.On Sept 8, SC observed that where a resolution plan for a stalled housing project has been approved, administrative authorities handling development permissions must take an expeditious and reasoned decision. A bench of Justices J B Pardiwala and K Vinod Chandran allowed the developer to build a 24-metre-wide pathway along three boundaries of the project’s GH-1 plot, stating it cannot claim ownership or title over the pathway, though access to the project will be provided at one point determined by GDA and will not be exclusive to the project.In its Aug 31 order, the bench had directed the developer to undertake all internal and external development work up to the approach road, including the pathway.GDA vice chairperson Nand Kishore Kalal said the revised plan has been approved by the GDA Board under the Uttar Pradesh Model Building Construction and Development Bylaws, 2025. “The revised building plan will be processed on FastPass portal within a fortnight in the interests of the homebuyers,” he said.
