RWA opposes nod for OC, seeks recheck of amenities at society in Gurgaon

Gurgaon: A residents’ welfare association (RWA) has challenged the occupation certificate (OC) granted to a project in Sector 92, alleging that critical infrastructure and safety compliances need to be independently verified on the ground before the OC is allowed to operate.The OC, dated Aug 10, was issued to SARE Gurgaon for T7 — now referred to as G1, G2 and G3 — in the 48.8-acre group housing colony.Challenging the OC for the 276-unit T7 tower, Royal Green Owners Condominium Association (RWA) of Rising Homes/Sare Homes has sent its formal objection to the department of town & country planning (DTCP), senior town planner, district town planner and other concerned authorities.RWA’s objection focuses on four key issues — sewerage capacity, 414 ECS parking, fire-tender access and mandatory green-area compliance — filed under Codes 4.10 and 4.12 of Haryana Building Code, 2017.RWA president Praveen Malik has sought an immediate joint physical inspection, contending that occupation of the new tower could directly affect infrastructure and common facilities already being used by existing residents.It has now filed its formal objection within the prescribed 30-day period and urged the authorities to reconsider the operation of the OC until the allegations are independently examined.The association said it had first sought clarifications from the developer on the issues but did not receive a response.A spokesperson for the developer told TOI, “Sare Homes (currently Rising Homes) was admitted into insolvency in 2021 and we have taken this project through NCLT order dated April 2023. Project is being implemented as per the approved building plans. DTCP approved the building plans and we are implementing it. The 276 units were sold during 2011-14 and built in 2017 by erstwhile management. We have just completed the works and obtained OC from DTCP in Aug 2026.RWA’s strongest concern is sewerage capacity. It claims there is no clearly identifiable operational sewerage connection dedicated to T7 leading to an adequately augmented STP or an operational public sewerage network.It has asked authorities to physically verify the entire sewerage chain from T7 to the final treatment/disposal or reuse point, including capacity calculations.The association has also questioned the availability of 414 ECS parking spaces for T7. With 276 dwelling units and a claimed requirement of 1.5 ECS per unit, it has calculated the requirement at 414 ECS.It wants authorities to identify these spaces physically and legally and ensure that parking or common areas already serving earlier phases are not counted for the new tower.Fire-tender access is another major concern. RWA has pointed to a sharp turn on the approach from the main gate towards T7 and asked fire & emergency services to conduct an actual fire-tender movement trial.It wants the authorities to verify the turning radius, road width, load-bearing capacity, obstructions and whether a full-size fire tender can reach the designated firefighting positions.RWA has demanded a colony-wide green-area audit, alleging that portions originally earmarked as green/open spaces have subsequently been used for parking or covered with fixed pavers.It wants the sanctioned green-area requirement compared with the area actually available on site.The association has argued that common areas, parking, access roads, green spaces and infrastructure already serving existing residents cannot be appropriated for T7 without lawful entitlement, sanctioned approval, adequate capacity and protection of existing owners’ rights.The OC itself makes parking subject to the designated parking area, requires compliance with fire-service conditions and states that violation of its conditions can render the certificate null and void.RWA has sought verification of the sanctioned and as-built plans, parking and ECS calculations, fire approvals, sewerage and STP records, green-area calculations and the inspection reports relied upon for granting the OC.
